1. Agreement and operator
RISE 11 is operated by MerchNique Technologies Private Limited ("MerchNique," "we," "us," or "our"). These Terms form a binding agreement between MerchNique and the person or organization using RISE 11. If you use RISE 11 for a club, academy, scouting organization, or other entity, you confirm that you can bind that entity to these Terms.
By creating an account, accepting a policy update, or continuing to use the service, you agree to these Terms, the Privacy Notice, and the Community & Safety Standards. If you do not agree, do not use the service.
2. Eligibility, age, and guardians
- You must provide your real date of birth and accurate identity information.
- A child may use only the features permitted for their age and only with the guardian permissions required by RISE 11 and applicable law.
- A guardian granting consent confirms that they are legally authorized to act for the child and understands that permissions can be changed or revoked in the guardian controls.
- Professional, organization-management, and administrator capabilities are adult-only and may require identity, role, employment, or organization verification.
- You may not use RISE 11 if your account is suspended, if the law bars you from the service, or if you are subject to restrictions that make participation with children inappropriate or unlawful.
3. Accounts and security
One person must not impersonate another, create deceptive profiles, or transfer an account. Keep credentials and recovery codes confidential, use multi-factor authentication when available, and tell us promptly about suspected compromise. You are responsible for activity performed through your account until you report unauthorized access.
We may require email, professional, organization, or safety verification; revoke sessions; or limit sensitive actions when necessary to protect users. Verification is a platform trust signal, not an endorsement, employment check, safeguarding certificate, or guarantee of conduct.
4. What RISE 11 provides
RISE 11 provides tools for football profiles, development records, evidence media, discovery, challenges, messaging, teams, scouting, reports, organizations, and related safety and administration workflows. Features and eligibility vary by role, verification, plan, age, guardian permission, location, and platform availability.
RISE 11 does not act as a football agent, employer, educational institution, medical provider, club, academy, or governing body. A profile, ranking, report, badge, comparison, or recommendation does not promise selection, a trial, a scholarship, a contract, employment, or a particular sporting outcome. Users must independently assess sporting, medical, safeguarding, immigration, education, and contractual decisions.
5. Your content and permissions
You retain ownership of content you lawfully submit. You grant MerchNique a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for technical delivery, moderate, display, and distribute that content only as needed to operate, secure, improve, and provide RISE 11 according to your visibility settings and permissions. This license ends when the content is deleted, except for lawful retention, safety evidence, backups awaiting expiry, and content shared with others that they are entitled to retain.
- You must own the content or have every permission needed to upload and share it.
- You must have authority to upload a child's media or information.
- You must not expose another person's private scouting, medical, identity, or contact information.
- You must not manipulate evidence, statistics, credentials, or professional affiliations.
- Reports, assessments, and scouting notes must be relevant, professional, supportable, and accessible only to authorized recipients.
6. Prohibited conduct
You must not use RISE 11 to:
- groom, exploit, sexualize, threaten, bully, stalk, or endanger any person;
- create or share child sexual abuse material or non-consensual intimate content;
- discriminate unlawfully or promote hatred or violence;
- defraud users, solicit unauthorized payments, fix matches, gamble unlawfully, or misrepresent opportunities;
- infringe privacy, publicity, copyright, trademark, database, or other rights;
- scrape, harvest, deanonymize, sell, or build unauthorized datasets or facial-recognition systems from platform data;
- probe, disrupt, reverse engineer, evade access controls, upload malware, or abuse APIs, storage, messaging, or reporting;
- circumvent blocks, suspensions, guardian controls, professional verification, quotas, or moderation decisions; or
- use platform information to make unlawful or solely automated decisions with legal or similarly significant effects.
7. Safety, reporting, and cooperation
Use in-product report and block controls for unsafe behavior. For an immediate threat, contact local emergency services first. We may preserve evidence, restrict visibility, suspend accounts, notify guardians, and cooperate with competent authorities when required or reasonably necessary to protect a person, investigate abuse, or comply with law.
Content involving suspected child sexual exploitation or other serious illegal harm may be reported to appropriate authorities. Do not download, redistribute, or investigate illegal material yourself; report the account or content and preserve only lawful reference information.
8. Organizations and professional users
An organization controls access granted through its verified membership. Owners and authorized administrators are responsible for staff invitations, role accuracy, lawful instructions, safeguarding, and removal of access when a relationship ends. Professional users must keep reports confidential and use player information only for legitimate football purposes within their authority.
Commercial entitlements, limits, expiry, and grace periods are enforced by the service. Any paid plan, invoice, refund, tax, or procurement terms must be agreed in a separate order or written commercial agreement until self-service billing is expressly made available.
9. Third-party services
RISE 11 may use infrastructure, storage, email, web-push, embedded video, app-store, identity, or security providers. Their services may have separate terms. External links are provided for convenience; MerchNique does not control third-party content. YouTube evidence may be displayed using privacy-enhanced embedding, but YouTube's terms and privacy practices still apply when you interact with it.
10. MerchNique intellectual property
RISE 11 software, branding, design, documentation, taxonomies, and other platform materials are owned by MerchNique or its licensors. Subject to these Terms, we grant you a limited, revocable, non-transferable right to use the service for its intended purpose. No right to source code, branding, bulk data, models, or commercial redistribution is granted.
11. Availability and changes
We work to provide a secure and reliable service but cannot promise uninterrupted availability. Maintenance, abuse prevention, provider failures, emergencies, legal requirements, or product changes may affect access. We may change or discontinue features while taking reasonable steps to protect existing rights and data-export capabilities.
12. Suspension, deactivation, and termination
You may deactivate your account through available controls. We may restrict or suspend an account to investigate risk, enforce these Terms, comply with law, or protect users and the service. Where appropriate, we will provide a reason and an appeal or grievance path. Serious or urgent safety matters may require immediate action without advance notice.
Deactivation ends ordinary use but does not automatically erase records we must retain for security, safeguarding, disputes, legal obligations, or the rights of others. Privacy requests are handled under the Privacy Notice.
13. Disclaimers and liability
To the maximum extent permitted by law, RISE 11 is provided on an"as available" basis without implied guarantees of sporting outcome, fitness for a particular recruitment decision, or uninterrupted operation. Nothing in these Terms excludes a warranty, remedy, or liability that law does not allow us to exclude, including applicable consumer rights.
To the maximum extent permitted by law, MerchNique is not liable for indirect, incidental, special, exemplary, or consequential loss arising from use of the service, third-party conduct, or decisions based on user content. These limits do not apply to fraud, wilful misconduct, personal injury caused by negligence, or any other liability that cannot lawfully be limited.
14. Responsibility for claims
If you use RISE 11 for an organization or commercial purpose, you will defend and indemnify MerchNique against third-party claims caused by your unlawful content, misuse, breach of these Terms, or infringement of rights, except to the extent caused by MerchNique. This section does not reduce non-waivable consumer protections.
15. Governing law and grievances
These Terms are governed by the laws of India, without limiting mandatory protections that apply where you live. Courts with competent jurisdiction under applicable law may hear disputes. Before filing a claim, please allow us a reasonable opportunity to resolve it through the grievance process.
Grievance Officer: Ronnie Thomas, Founder & CEO, MerchNique Technologies Private Limited, Bhagat Singh Marg, Durgapur, West Bengal, India. Email grievance@merchnique.com. General support is available at support@merchnique.cloud.
16. Policy changes
We publish a stable version and effective date. Material changes may require renewed acceptance before authenticated features are available. Changes do not retroactively remove rights already accrued. If any section is unenforceable, the remaining sections continue to apply.
